// 01 · THE MOMENT

For the teams shipping copy faster than counsel can review it.

The MiCA transitional window closes on 1 July 2026, and most formerly-registered EU crypto firms are still working toward authorisation. Marketing keeps shipping — landing pages, ads, emails, KOL briefs.

// USE 01
Pre-flight every asset

Run every asset before it goes live.

// USE 02
Brief KOLs and agencies

Check influencer creative against disclosure and risk-warning rules before it ships under your brand.

// USE 03
Triage a back-catalogue

Work through everything already live and rank what to fix first.

// 02 · WHAT A VERDICT LOOKS LIKE

This is the output. Read it before you pay for it.

An audit we ran with the MiCA pack — not a mockup. A fictional exchange hero block we wrote ourselves, audited against all 40 MiCA rules. We never use a customer’s or a prospect’s copy as a sample.

=== MICA SUBSCRIBER AUDIT — SAMPLE-001 ===
Asset type: Landing-page hero block (fictional exchange, written by NorthPoint)
Submitted:     2026-07-27T09:12:00Z
Jurisdictions: EU general
Pack:          MiCA marketing self-audit — 40 rules

ASSET UNDER AUDIT
  H1: "Earn up to 12% APY on your idle crypto."
  Sub: "Europe's best rates, with no lock-up."
  CTA:    [ Create account ]
  Footer: "Crypto-assets are highly volatile and your capital is at risk." (10px, grey)

VERDICT: 1 FAIL · 3 FLAG · 36 PASS — DO NOT SHIP

❌ Rule 10 — Substantiation for numerical claims
   Citation: Article 88(1) + ESMA guidance on advertising of investment services
   Triggered text: "Earn up to 12% APY on your idle crypto."
   Issue: The headline number carries the entire offer but is undated,
                    unsourced and has no stated methodology, so a consumer cannot
                    verify it.
   Suggested rewrite: "Earn a variable rate — 12% APY on [asset] as of 27 July 2026,
                    per our published rate schedule. Rates change daily."

⚠ Rule 11 — No emphasis on potential gains without potential losses
   Citation: Article 88(1) + ESMA guidance — balanced presentation
   Triggered text: "Earn up to 12% APY" / footer: "...your capital is at risk."
   Issue: The gain sits in the hero; the only loss language is a 10px
                    footer line, so the block that does the selling is unbalanced.
   Suggested action: Carry the loss into the same sentence as the gain.

⚠ Rule 6 — Risk warning prominence
   Citation: Article 88(1) + ESMA Guidelines on Marketing Communications
   Triggered text: "Crypto-assets are highly volatile and your capital is at risk."
   Issue: The warning is substantive (Rule 1 passes) but sits footer-only,
                    at a weight far below the hero claim it is meant to qualify.
   Suggested action: Move it into the same viewport as the H1 and CTA, at body-copy
                    weight; drop the footer duplicate once moved.

⚠ Rule 3 — Unsubstantiated superlatives
   Citation: Article 88(1) — fair, clear, not misleading
   Triggered text:  "Europe's best rates"
   Issue: A comparative claim with no source, no date and no comparison set.
   Suggested action: Remove it, or replace with a dated, sourced comparison.

✓ Rules 1, 2, 4, 5, 7–9, 12–40 — passed or not applicable to this asset.

OPERATOR'S READ:
This is fixable in one pass. The highest-impact single change is moving the risk line
into the hero and attaching it to the yield claim — that addresses Rule 6 and Rule 11
together. The 12% number is the one thing that must not ship undated.

// WHAT YOU RECEIVE, PER ASSET

Every run returns the same six things.

  • A verdict line — N FAIL · M FLAG · K PASS, with a plain ship / do-not-ship call.
  • Per-rule analysis across the whole pack — MiCA 40 rules, GDPR 30 rules, FCA 25 rules. Every rule assessed, not only the ones that trigger.
  • The triggered text, quoted back.
  • A concrete rewrite for every FAIL and a suggested action for every FLAG — drafted copy, not “consult someone”.
  • An operator’s read — what to fix first.
  • An audit-history row (JSON) — a dated record, so you can show your work later.

What it is not: a certification, an approval, or a promise that an asset will pass a regulator’s assessment.

The Compliance Self-Audit Suite is an operator-grade heuristic that returns information to help you identify and fix likely marketing-compliance issues. It is not legal advice and does not guarantee a regulatory outcome or that any asset will pass a regulator's assessment. For a binding view on a specific promotion, authorisation, approval or exemption, retain qualified counsel in the relevant jurisdiction.
