The rule.
“has not been reviewed or approved by any competent authority in any Member State”
Verbatim extract, read on 4 November 2026 from the source below. Everything else on this page is NorthPoint’s plain-English reading.
What it requires.
- A clear and prominent statement that the marketing communication has not been reviewed or approved by any competent authority in any Member State, and that the named party is solely responsible for its content.
- Prominent means it is seen with the claim, not hidden in a footer the reader never reaches.
Who it applies to.
Marketing communications for a crypto-asset other than an asset-referenced token or an e-money token. The wording names the offeror, the person seeking admission to trading or the trading-platform operator, depending on who prepared it.
Common violations in marketing copy.
MiCA-approved token.
Implies a regulator endorsed the token — the opposite of the statement the provision requires.
(statement only in the legal page linked from the footer)
A statement the reader does not see is not prominent.
Non-compliant vs compliant.
“Fully regulated and approved under MiCA.”
“This crypto-asset marketing communication has not been reviewed or approved by any competent authority in any Member State of the European Union. [Offeror] is solely responsible for its content.”
