The rule.
“shall comply with all the following requirements”
Verbatim extract, read on 4 November 2026 from the source below. Everything else on this page is NorthPoint’s plain-English reading.
What it requires.
- Points (a) to (d): clearly identifiable as marketing; fair, clear and not misleading; consistent with the crypto-asset white paper; and a clear statement that the white paper has been published, with the issuer's website, telephone number and email address.
- Elsewhere in Article 53: the communications and any changes are published on the issuer's website (53(3)), and none may be disseminated before the white paper is published (53(6)).
Who it applies to.
Marketing communications for an offer to the public, or an admission to trading, of an e-money token (EMT).
Common violations in marketing copy.
Hold [EMT] and earn 5% a year.
Misleading where the white paper describes no such return; the presentation makes the token look like a deposit with interest.
[EMT] — the euro, upgraded.
Missing the statement that a white paper has been published and the issuer's contact details.
Non-compliant vs compliant.
“Better than a bank account: [EMT] pays you to hold it.”
“[EMT] is an e-money token issued by [Issuer]. A crypto-asset white paper is published at [website]. Contact: [phone] · [email].”
