Since 1 July 2026, a non-EEA firm without a MiCA authorisation may serve EEA clients only on the client’s own initiative, and ESMA has told national authorities to act against unauthorised firms (statement, 17 April 2026). A client’s declaration is not evidence. A dated record is.
